Public and private partnership agreements

On October 1, 2009 the Law on Public­ and Private Partnerships came into force. It provides that the Register of Enterprises has a new public register - The Register of Public and Private Partnership Agreements. Information regarding the purchasing agreement of a partnership or concession agreement is recorded in this register.

Public and private partnership is a cooperation between private and public sector which is simultaneously characterized by the following features:

A  purchasing agreement of a partnership is an agreement of public construction works (if it also provides the management of the construction built) or an agreement of public services (if it also provides construction works, that is an insignificant part of the subject of this law) which is concluded by a public partner and a private partner for a time period that is longer than five years.

A concession agreement is a construction works concession agreement or a service concession agreement  which is concluded by a public partner and a private partner.
