The contract shall be entered into by notarial arrangements (CVL 115 p .1) with both married or married couples, but, if the married are minor, their legal representatives shall also be present. Its breakers cannot be replaced by trustees. Two types of marriage contracts can be entered into - the separation of all the spouses' property or the community.

Conditions:

• If the contract is entered into for the community of the property of the spouses, the property belonging to the spouse prior to the marriage, as well as the property acquired during the marriage, shall be considered to be shared and indivisible. When there is a community of the spouses' property, it does not include the property specified by the spouses in the marriage agreement as the individual property.
• On the other hand, the divorce of the spouses' entire property is determined by what kind of property the spouse owns. This applies to both movable and immovable property, which allows the spouse to act independently of the other spouse's consent.
