As of 18 September 2018, pursuant to Section 14, Paragraph One of the Commercial Pledge Law, applications and the documents attached thereto must be submitted to the Register electronically, using the Commercial Pledge e‑Service developed by the Register – Commercial Pledge e‑Service.
In accordance with Section 14, Paragraph One of the Commercial Pledge Law, applications and supporting documents must be submitted to the Enterprise Register of the Republic of Latvia (hereinafter – the Register) electronically, using the online form specified by the Register.
The Enterprise Register of the Republic of Latvia has developed the Commercial Pledge e‑Service (hereinafter – the e‑Service) to enable users to prepare and submit commercial pledge applications to the Register, as well as to receive response documents online.
The e‑Service is available at https://komerckila.ur.gov.lv within the domain managed by the Register and is also accessible via the official website of the Register – ur.gov.lv.
In order to use the e‑Service (support materials for using the e‑Service and the e‑Service user manual), the user must first authenticate in the system. Authentication in the e‑Service is possible in two ways:
- using the authentication tool of the portal www.latvija.lv;
- by logging in to the e‑Service with a username and password. In order to use this authentication method, the Register and the respective organisation must conclude an agreement on the use of the e‑Service.
Concluding an agreement on the use of the e‑Service is not mandatory and is a matter of free choice.
Within the e‑Service, users can:
- electronically complete, edit, save in PDF format for electronic signing, submit, cancel or withdraw applications for: registration of a new commercial pledge, registration of amendments to commercial pledge terms, registration of renewal of a commercial pledge, registration of assignment of claims secured by a commercial pledge, registration of a change of pledgee in cases of business transfer or reorganisation, registration of the exercise of commercial pledge rights, registration of a commercial pledge administrator, deletion of a commercial pledge;
- when completing an application, verify and import information about a legal person from the information system of the Enterprise Register;
- when completing an application, verify and import information from the Trademark Register and Design Register maintained by the Patent Office
(due to technical reasons, this functionality is currently unavailable and data must be entered manually); - re‑submit an application to the Register if the decision of a state notary of the Register has been negative;
- search for and save completed and submitted applications.
By concluding an agreement on the use of the e‑Service, users gain access to additional functions not available through authentication via www.latvija.lv, including the ability to:
- administer user rights for employees of the organisation (define user groups, assign roles and access rights, etc.);
- when completing an application, verify and import information from: the State Register of Vehicles and Drivers maintained by the Road Traffic Safety Directorate (CSDD), the Registers of Herds, Holdings and Animals maintained by the Rural Support Service;
- work with all applications submitted by all employees of the organisation;
- when entering data in an application, load data from a commercial pledge deed if the contracting organisation is defined as a party to the current records for the relevant commercial pledge number.
The procedure for concluding the Agreement on the Use of the Electronic Service for Submitting Applications for Entries in the Commercial Pledge Register, including granting access to the Commercial Pledge e‑Service, is as follows:
- The Enterprise Register and the respective authority (hereinafter – the Authority) conclude an agreement
“On the Use of the Electronic Service for Submitting Applications for Entries in the Commercial Pledge Register”.
The agreement draft must be completed with the details of the contracting party and sent to the Enterprise Register via its e‑Address or by email to pasts@ur.gov.lv. - After the agreement is concluded, the Authority submits an application to the Enterprise Register requesting the granting of administrator rights to an employee of the Authority (hereinafter – the Administrator), indicating the Administrator’s given name, surname, personal identity number and external IP address from which connections will be made.
- Within 10 working days, the Enterprise Register creates and assigns login credentials (username and password) to the Administrator, enabling work in the Commercial Pledge e‑Service, including the administration of user groups.
- The Enterprise Register informs the contact person of the Authority about the assignment of the credentials and indicates where they can be collected.
- The Enterprise Register hands over the credentials to the Administrator specified in the application in a sealed envelope, against a hand‑over acceptance certificate.
The Administrator authenticates in the Commercial Pledge e‑Service using the assigned credentials and administers user access rights for employees by assigning roles (“User” or “Administrator”) and access permissions.
